Even if we were to remove Director of National Intelligence Tulsi Gabbard from the equation altogether, the FBI’s execution of a search warrant at the Fulton County elections office near Atlanta as part of Donald Trump’s ongoing crusade related to his 2020 election defeat would still be awfully tough to defend.

There’s no credible reason for federal law enforcement to seize these election materials, which have already been thoroughly scrutinized, just as there’s no reason for the FBI to act as a vehicle for the president’s discredited conspiracy theories. What’s more, as The New York Times noted, there are also related concerns about whether this “might also be a harbinger of things to come, signaling Mr. Trump’s growing willingness to use the vast powers of federal law enforcement to intervene in election matters in the lead-up to the critical 2026 midterms, which will determine the extent of his authority for the remainder of his second term.”

But that Gabbard, eager to work her way back into the White House’s good graces, personally participated in the raid in Georgia, adds a scandalous element to a burgeoning controversy. As a Politico report summarized:

“This is a person who has got no business interfering in elections and to, frankly, follow up on President Trump’s obsession about the fact that he lost in 2020, that he lost the state of Georgia,” Warner, D-Va., added. “So would like to see the underlying basis for the war in the first place, but to see her, you know, skulking around in a baseball cap [in] the picture that was posted, you never thought you could make this stuff up.”

FBI agents searched the county elections office near Atlanta on Wednesday and seized 700 boxes of materials related to the 2020 election, county officials said. Gabbard was seen at the site dressed in black and wearing a baseball cap and a long coat.

A top Justice Department official defended Director of National Intelligence Tulsi Gabbard’s presence as the FBI seized 2020 election ballots from a warehouse outside Atlanta earlier this week.

Democratic lawmakers and former officials have said Gabbard’s role at the execution of a criminal search warrant appeared to violate longstanding policies and traditions that sharply limit the activities of intelligence officials on U.S. soil, but Deputy Attorney General Todd Blanche insisted Friday that her presence at the FBI-led search was appropriate.

“She’s an extraordinarily important part of this administration,” Blanche said. “This administration coordinates everything we do as a group. … Of course, that’s a big part of her job. And so the fact that she was present in Atlanta that day is something that shouldn’t surprise anybody.”

A federal magistrate judge approved a warrant allowing FBI agents to seize all Fulton County ballots from the 2020 election as part of an investigation into potential criminal violations of federal election laws. However, details of what evidence prosecutors presented to the judge remain under seal.

By any measure, the F.B.I.’s search of an election center in Fulton County, Ga., last week was extraordinary. Agents seized truckloads of 2020 ballots, as President Trump harnessed the levers of government to not only buttress his false claims of widespread voter fraud, but also to try to build a criminal case against those he believes wronged him.

What happened the next day was in some ways even more unusual, The New York Times has learned.

Behind closed doors, Tulsi Gabbard, the director of national intelligence, met with some of the same F.B.I. agents, members of the bureau’s field office in Atlanta, which is conducting the election inquiry, three people with knowledge of the meeting said. They could not say why Ms. Gabbard, who also appeared on site at the search, was there, but her continued presence has raised eyebrows given that her role overseeing the nation’s intelligence agencies does not include on-site involvement in criminal investigative work.

What occurred during the meeting was even further outside the bounds of normal law enforcement procedure. Ms. Gabbard used her cellphone to call Mr. Trump, who did not initially pick up but called back shortly after, the people said.

The president addressed the agents on speakerphone, asking them questions as well as praising and thanking them for their work on the inquiry, according to three people with knowledge of the discussion.

When Americans are being killed in broad daylight by immigration agents and the Department of Justice continues to withhold millions of records related to Jeffrey Epstein, the FBI raiding Fulton County, Georgia’s election hub, last week and seizing 700 boxes of documents related to the 2020 elections might seem like just a distraction. The reality is much scarier than that and it’s not about 2020.

As much as Trump obsesses about losing Georgia — and the presidency — to Joe Biden in 2020, and as much as he blames voters in Fulton County for his loss, Wednesday’s raid wasn’t about any past election in Georgia. It was about future elections in a critical swing state.

Officials in Georgia filed a court challenge Wednesday seeking the return of scores of election records seized by federal agents last week from a warehouse in Fulton County, which has been central to right-wing conspiracy theories about President Donald Trump’s loss in the 2020 presidential election.

Robb Pitts, chairman of the Fulton County Board of Commissioners, vowed that county officials would use “every resource” to secure ballots and other material and cast the court fight as part of a broader effort to ensure the future of independent elections.


The seizure never should have been authorized in the first place.
