I'm not a lawyer but I would assume that would be the case only if you used it to rigged an election unless a specific law was in place banning such. Similar to owning a gun and actually shooting someone with it for anything but self defense.

The guy doing the original software already testified before congress prior to the election how it was done. Why did the election officials in some of those states allow an update on Dominion machines the day before the election? Those machines were no longer certified when they did that.
