It hasn't been proven Bull. The Rosebud reservation is arguing that at least two things give them the right to contest the pipeline. Who knows how it will work out in the courts? The tribe is arguing that the treaty that ceded the lands is invalid because it was changed without their approval and the issue of trust lands that will be impacted by the pipeline has not been resolved. All you have to do is google map Rosebud reservation and you will see the trust lands in question. You may have to zoom in before they show up, but they do show up. Almost all the maps being used show only the main body of the reservation and exclude the scattered but many parcels and tracts designated as trust lands. I don't know how it will work out in the end, but to imply the tribe has no legal standing or arguments seems a bit early at this stage.
Uh huh...well, I find the timing pretty strange don't you? There are several heavily monied interests, including Warren Buffet (the tax cheat) intervening rather than lose their tanker and rail traffic to Port Aruthur...and others who talk the "green game" but invest in other energy sources more harmful than a pipeline (which is the safest way to move oil and has been for 100 years). This is another stalling technique designed to bankrupt the canadians in legal fees.....6 years is long enough....no more stalling....every legit argument has been heard...time to build it and they will come Spring.
