Judge Will Release More Evidence in Trump's Jan. 6 Case On Friday​

Source documents and an appendix detailing more about Trump’s alleged criminal attempt to overturn the results of the 2020 election will hit the public record on Friday, according to a judge’s order.

The appendix is a follow-up to the immunity brief special counsel Jack Smith laid out earlier this month establishing evidence he intends to use at Trump’s election subversion trial after the Supreme Court issued its decision granting presidents immunity for their official acts.

U.S. District Judge Tanya Chutkan approved the public release on the federal criminal docket in Washington, D.C., following weeks of Trump requesting to keep the appendix out of the public eye. His lawyers asked early Thursday to delay the release until Nov. 14 but Chutkan rejected the request. She also rebuffed his assertions that releasing the documents is election interference.

“There is undoubtedly a public interest in courts not inserting themselves into elections, or appearing to do so. But litigation’s incidental effects on politics are not the same as the court’s intentional interference with them,” she wrote.

If the court withheld that information the public “otherwise had a right to access” because of the potential political consequences, that itself could constitute or appear to constitute election interference, she ruled.
