Pelosi threat to sue Bush over Iraq bill | TheHill

House Speaker Nancy Pelosi (D-Calif.) is threatening to take President Bush to court if he issues a signing statement as a way of sidestepping a carefully crafted compromise Iraq war spending bill.

Pelosi recently told a group of liberal bloggers, “We can take the president to court” if he issues a signing statement, according to Kid Oakland, a blogger who covered Pelosi’s remarks for the liberal website dailykos.com.

“The president has made excessive use of signing statements and Congress is considering ways to respond to this executive-branch overreaching,” a spokesman for Pelosi, Nadeam Elshami, said. “Whether through the oversight or appropriations process or by enacting new legislation, the Democratic Congress will challenge the president’s non-enforcement of the laws.”

It is a scenario for which few lawmakers have planned. Indicating that he may consider attaching a signing statement to a future supplemental spending measure, Bush last week wrote in his veto message, “This legislation is unconstitutional because it purports to direct the conduct of operations of the war in a way that infringes upon the powers vested in the presidency.”

Congressional members claim that the bill as it was signed was never passed in the House. Namely, the version that was passed in the House provided for 36 months of durable medical equipment funding, whereas the version that the President signed, and which was passed in the Senate, provides for only 13 months of such funding. The basis for the suit is the allegation that President Bush violated constitutionally mandated lawmaking procedure. The Congressional members bringing the suit are: Rep. John Conyers (MI), Rep. George Miller (CA), Rep. John Dingell (MI), Rep. Charles Rangel (NY), Rep. James Oberstar (MN), Rep. Barney Frank (MA), Rep. Collin Peterson (MN), Rep. Bennie Thompson (MS), Rep. Louise Slaughter (NY), Rep. Fortney Pete Stark (CA), and Rep. Sherrod Brown (OH). Representing the legislators in the suit is Duke Law School's Professor Erwin Chemerinsky.

The House or a House committee can sue an executive agency or White House officials to seek documents or testimony, since the House has an independent authority to investigate.

Butterfield (D-N.C.), a former judge, said the latest suit introduced a host of new legal questions. “Do you really want to cede to the courts the authority to resolve disputes between the branches?” he asked. “Would you want the president to sue the House for missing a budget deadline? How would it end?”

Legal experts note that the Supreme Court has previously refused to get involved in political spats between Congress and the president, and for that reason the House lawsuit is expected to fail.

Democrats: Have a reason, decide to sue.

Republicans: Decide to sue, go searching for a reason. Which they still haven't found.

So, just another fine thread showing Republican dishonesty and inconsistency, but not much else. There was really no reason for it. We already know the depths Republicans will stoop to in their quest to excuse anything their party does.
