Obama didn’t take documents. Biden could have been prosecuted if they could prove he intentionally took them, but they couldn’t.

Trump stopped being president and at that time he had no legal authority to possess any of the highly classified documents in his basement. And we haven’t even talked about his obstruction of justice by keeping them despite having had a subpoena to turn them over.
