The "gay panic" defense is strictly an appeal to prejudice. A defendant remains totally free to mount a defense that s/he was in fear of bodily harm and acted in self defense. The defense can present evidence of the relative physical sizes of the defendant and victim, their placement in the room, their actions, and what barriers were present that prevented the defendant from leaving.
