Trump can nominate anyone he wants as a cabinet member, as long as he feels that person is qualified for the job. It's not like Musk is going to pay him for the cabinet position, Trump is already wealthy.

It has to do with potential conflict of interest and possible quid pro quo - Musk helps Trump get elected and Trump gives him a position in his administration. Due to the access that Musk will have in that position running the "government efficiency" office (DOGE), it's a valid concern if Musk will use it to ensure that none of his contracts get the axe.

DOGE is not an official agency of the government, it is an entity that will operate outside the confines of government. All they're really going to do is study the government, find out where the waste and inefficiency is, and report it to those who have the power to do something about it.
