Just because something is appealed does not automatically mean the appeal will be successful. The only things that would fall under "official duties" after his 60 something court cases were thrown out for lack of evidence and after Rudy Guilianni, Mark Meadows, and all the others told him he had legitimately lost the election, was to offer a concession speech and form a transition team to prepare for leaving.

You are already misinterpreting yesterday's SCOTUS ruling. Not EVERYTHING a POTUS does while in office or after being elected falls within the scope of "official duties." In this case paying off a porn star to illegally influence an election PROBABLY wouldn't qualify.

As I repeatedly noted, Judge Chutkan didn't bother to hold a hearing about immunity to hash out which elements of the J6 indictment related to presidential v personal/unofficial conduct. She just issued her landmark opinion without additional input.

I've also noted the appellate panel's similar rush to judgment.
