Ordinarily, a government can exercise eminent domain only if its taking will be for a "public use" - which may be expansively defined along the lines of public "safety, health, interest, or convenience". Perhaps the most common example of a "public use" is the taking of land to build or expand a public road or highway. Public use could also include the taking of land to build a school or municipal building, for a public park, or to redevelop a "blighted" property or neighborhood.



All done by legal process.

If the government is not successful, or if the property owner is not satisfied with the outcome, either side may appeal the decision.

Secondly, you can keep calling me a liberal if you want, but that won't make it true. I'm a libertarian, not a liberal. As such, I'll consistently defend property rights.

Finally, if you don't support eminent domain then explain what you want to happen. They're going to build the mosque on this property, it doesn't matter if you want them to or not. Short of advocating that the government step in and force them to build elsewhere there's nothing to be done about it. So which is it? Putting a Mosque near ground zero will remind Americans about what Muslims did to America on 9/11. Rather than 'creating tolerance' for Muslims it will create only distrust and disgust towards Muslims. ;)

This issue is a litmus test of whether people believe in the Constitution or not. If you don't like the idea of a Mosque not really at ground zero in the first place but in the vicinity, I think you're silly but whatever. Bigots forget that Muslim Americans died on 9/11 too, Muslim Americans helped rescue and clean up and grieved.
