Seems the guy is an ATTN defending a client against the state shut down of restaurants while leaving these open......he might know a thing or maybe eh

Do you have a link to the judgement? ... to the complaint? ... to the answer? ... did you know everybody is entitled to a defense attorney? ... do you think this attorney gets his legal information off of Twitter? ...

Hey, the Lucky Star casino in OK is still open, and they have been actively advertising on the television about how they are open, that they are doing things to try to keep people safe (regular cleanings), as well as the fact that they want everyone who goes there to wear a mask.

Matter of fact, they have been running promotions for various things they are doing in January.

Federal law always overrides States law where the US Constitution explicitly says it does ... "To regulate Commerce with foreign Nations, and among the several States, and with the Indian Tribes;" --- Article I, Section 8, "Clause" 3 ...

The article says this is how the judge ruled ... thus tribal casinos were allowed to stay open ... yes, I did read the article, how else would I know the campaign contributions ...

Minnesota tribes were the first in the nation to negotiate and sign gaming compacts with a state government. Both the tribes and the state agreed to limit casinos to video games of chance (slots) and blackjack. Additionally, both parties agreed that the compacts should be effective in perpetuity.

Minnesota has negotiated 22 tribal-state compacts with 11 Indian tribes, resulting in the establishment of 18 casinos in the state. The class III games permitted under these compacts are blackjack and video games of chance.

The compacts provide for inspection and approval of machines by the Minnesota Department of Public Safety, licensing of casino employees, machine payout percentages, and regulation of the play of blackjack. Not really.
The reservations are not under any state authority at all.
Those Tribal State Gaming Compacts are just agreements to ensure things run smoothly.
But the state could retaliate if the natives were not friendly.
For example, the state could block all the state roads leading to the reservation I suppose?
There is nothing natives could do if the state prevented anyone from going to the casinos.
