The U.S. 8th Circuit Court of Appeals temporarily blocked an injunction Wednesday that prevented federal immigration officers from retaliating against demonstrators.
A Friday ruling by U.S. District Judge Kate Menendez had prevented the U.S. Department of Homeland Security and Immigration and Customs Enforcement from detaining or tear gassing people who are engaging in peaceful and unobstructive protest, including observing Operation Metro Surge, which is the feds’ name for the incursion of over 3,000 immigration officers and agents in the Twin Cities.
The Wednesday decision granted Homeland Security its request for an administrative stay of Friday’s preliminary injunction. Ten of the 11 judges in the 8th Circuit Court of Appeals, which granted the stay, were appointed by Republican presidents, including four judges appointed by President Donald Trump.

The Trump administration argued in a motion filed on Tuesday that the lawsuit is based on five incidents in December that plaintiffs can “only speculate may recur,” and that plaintiffs can’t establish constitutional violations. Homeland Security said that the district court’s finding of a pattern of misconduct by ICE agents was “overblown.”

Law enforcement has no reason to deploy tear gas on a “peaceful protester” in the first place.
