I guess you could look at it that way, if you choose. I doubt law enforcement charged him that way, or that a jury will consider much except the evidence on the actual charges. Anyway you slice it, it boils down to whether they can prove drunk driving or if he was simply charged that way. Hopefully you are wrong, and he was not mischarged based on your feelings, but on actual breathalyzer and/or blood test for alcohol content. That is the only way there is any justice for the victims.
