Lindsey Halligan was not legally appointed as US Attorney.

She has never been senate confirmed. She’s never served in the DoJ. She was not first assistant.

All these would be necessary for her to be legally appointed as acting US Attorney, but none are true.

Her appointment will be thrown out and the case dismissed.

If she's an interim US attorney, she doesnt need senate confirmation. She can only be in this role for 120 days

This is exactly the same reason charges against Trump was dropped.

This is a similar situation to when Desiree Grace, who was the first deputy to Alina Habba, was fired so Habba could take her position, no Senate confirmation being necessary for the deputy's role, in order to allow Habba to run the office. This, after the time limit on Habba's temporary appointment expired. Ultimately, Habba's appointment as the #2 in the office was ruled illegal.

The issue in Halligan's case is both Seibert (the former US Attorney) and his deputy, Maya Song, were fired. It's just another cluster eff orchestrated by the orange piece of shit.

Erik Seibert was already appointed interim US attorney and was in the role for 120 days. Trump fired him. Now the courts get to appoint a prosecutor.

Erik Siebert was never the permanent attorney. He was always interim US attorney because he was never senate confirmed. When the 120 day clock expires, the court gets to decide who is US attorney, and they allowed Siebert to remain until confirmed.

Trump doesn’t get to keep appointing new interim US attorneys.
