Workable process. Employers have to prove there is a shortage, fly in workers, pay for their housing, engage a lawyer to apply for permits, and several other deep cost activities.
That works for $100,000 data scientists, not for day laborers. That’s why the black market is so large. We need to:
- Streamline visa processing with digital tools and faster approvals.
- Create multi-employer or portable visas so workers can change jobs without leaving the country.
- Broaden eligibility across more industries.
- Increase caps/quotas
If it’s not easy and cost efficient you get a black market.

Second. Either you dont know how jobs work or youre just typing words. Agriculture jobs are not near population centers and certainly not an after school job. Mike wants 15 year olds picking strawberries at night everyone!
Get a grip. If you were an employer you'd know there is a vast shortage of labor in America. We are at full employment. I am constantly hiring professionals in my role.

First off, nowhere in the regulation for H2A visa holders does it specify that you must “fly them” home. It merely states that the employer must provide transportation from their last worksite back to their place of recruitment. They even give an example in the regulation.
Nothing in that states they must be flown home to Mexico. The employer can buy them a bus ticket, and give them $50 for food, and send them to TX and that fulfills their requirements.
- “U.S. worker is recruited in Texas by a Michigan H-2A employer, and the worker goes on to a Wisconsin H-2A employer. The Wisconsin employer is responsible for transportation back to Texas.”
Now, you’re conflating them with skilled workers like Data Scientists from say India or wherever, that YOU recruit from India. That’s a different visa, and a different process.

Can the farmer not grow anything else that has a higher ROI and can use automation to harvest? Or, are we going to stay with the “buggy whip” argument, because that’s the only way you can have your slaves?If you dont want inexpensive fruit grown on US farms then they will shut down and strawberries will all be imported from Mexico. Maybe that is best for keeping cheap brown workers out of the US but it is not good for American fruit farms and people who want cheap US strawberries. Its all just a choice.
