"thinking" the election was fraudulent is insufficient cause to certify a slate to be counted by Congress. There has to be a legal determination as to which candidate won the popular vote within the state.

Where is the actual fraud, or is it just political positioning now being treated as a "crime" for political gain?

Not sure they were certified at all. If they were, it wasn't by someone authorized to certify them.

And that it wasn't accepted is not an excuse. If you offer to pay me to kill someone and I go to the police rather than accept your payment, you're still going to jail.
 
Biden's incompetence should be enough to be "remove from ballot" as well! Maybe, six (or more) Democrats should do the same!

This isn't murder, it's a process. murder is it's own crime regardless of intent. That just tells you the type of murder.

The fraud was to send fake electors. They were (fortunately) unsuccessful. But they still planned it. That's conspiracy to defraud.

Of course there was an intent to commit a crime. Sending fake electors to be counted by Congress is a crime. That's what they planned to do.

What law did they break by just sending non certified electors to congress?

It matters not if it was out in the open, which I'm not sure if that was the case. It was still an attempt to commit fraud. That is criminal even if their intent was political, not financial.

How do you commit fraud when your intentions are out for all to see? They were contesting State level elections, and saying they were doing it.

It was only out for all to see after their plan was exposed. And again, just planning the crime was a crime, even though it wasn't successfully pulled off. Just like a bunch of J6 convicts are in jail for planning an insurrection even though they failed to pull it off.

Something isn't exposed when people are aware of it as it is happening.

What crime? You can't plan a crime if you can say what the crime was. This is the circular logic of a flawed conspiracy charge.

No insurrection, because they had no mechanism to actually 1) take over the government or 2) stop the transition of power still weeks away.
