This is the last known photo of Garret Foster. Look closely you can clearly see the butt of the rifle behind his ear and him attempting to raise it. SGT Perry was faster on the draw, felt his life threatened as anyone would and shot Foster dead.

The DA brought charges on Perry but many issues were raised about this by the lead detectives on the case both of him ruled it justified. The DA however went through with a trial and Perry was found guilty. The lead detective in the case signed an affidavit swearing that the DA violated procedure and tampered with witnesses

If the gun wasn’t pointed at him, he has no justification to shoot. The photos and eyewitness testimony fail to corroborate his allegation that the gun was ever pointed at him.

Getting a pardon doesn’t make him innocent. It just makes him unaccountable.
