Sen. Tom Hawk, a Manhattan Democrat and a former school administrator, said that as a lifelong educator, he could not support the bill, which he viewed as having a chilling effect on teachers.

But supporters said the bill is necessary to ensure kids are protected from pornography at school and that teachers would not be prosecuted for teaching works of literary or scientific value.

So what is the truth? I can't for the life of me recall many, if any, incidences where pornography was allowed in school.

“My first thought: Oh no! This again? I’d be in trouble. I was showing my high school art students charcoal drawings of nude people just today. I do it all the time. You know when the religious laws regarding art are more restrictive than the European Renaissance, you’ve gone too damn far!

“It’s a very frightening thought for art and science teachers in particular,” she wrote.

Mark Desetti, legislative director of the Kansas National Education Association, the state’s largest teachers union, called the lack of debate on the bill extremely disappointing.

“There should’ve been at least objections made. I don’t know if it would’ve made a difference, but it should have been there,” Desetti said.

He contended the bill could allow a teacher to be prosecuted for teaching a controversial book that had been approved by the local school board for its literary and educational merit. He said even if prosecutions don’t result in convictions, their mere possibility would have a damaging impact on education in Kansas.

“We’re going to self-censor to the point where nothing controversial is ever put before kids,” Desetti said. “How do we get kids to think critically and challenge ideas? Everybody talks about let’s think out of the box. No, let’s not. Let’s cram everybody into this little box and scare them into not doing anything that people might find an objection to.”

From the Bill itself: SB 56 Bills and Resolutions Kansas State Legislature

(2) "harmful to minors" means that quality of any description,
exhibition, presentation or representation, in whatever form, of nudity,
sexual conduct, sexual excitement or sadomasochistic abuse when the
material or performance, taken as a whole or, with respect to a prosecution
for an act described by subsection (a)(1), that portion of the material that
was actually exposed to the view of minors, has the following
characteristics:

(A) The average adult person applying contemporary community
standards would find that the material or performance has a predominant
tendency to appeal to a prurient interest in sex to minors
;
(B) the average adult person applying contemporary community
standards would find that the material or performance depicts or describes
nudity, sexual conduct, sexual excitement or sadomasochistic abuse
in a
manner that is patently offensive to prevailing standards in the adult
community with respect to what is suitable for minors; and
(C) a reasonable person would find that the material or performance
lacks serious literary, scientific, educational, artistic or political value for
minors;
(3) "material" means any book, magazine, newspaper, pamphlet,
poster, print, picture, figure, image, description, motion picture film,
record, recording tape or video tape;
(4) "minor" means any unmarried person under 18 years of age;
(5) "nudity" means the showing of the human male or female genitals,
pubic area or buttocks with less than a full opaque covering; the showing
of the female breast with less than a full opaque covering of any portion
thereof below the top of the nipple; or the depiction of covered male
genitals in a discernible state of sexual excitement;

(6) "performance" means any motion picture, file, video tape, played
record, phonograph, tape recording, preview, trailer, play, show, skit, dance
or other exhibition performed or presented to or before an audience of one

or more, with or without consideration;
(7) "sadomasochistic abuse" means flagellation or torture by or upon
a person clad in undergarments, in a mask or bizarre costume or in the
condition of being fettered, bound or otherwise physically restrained on
the part of one so clothed;
(8) "sexual conduct" means acts of masturbation, homosexuality,
sexual intercourse or physical contact with a person's clothed or unclothed
genitals or pubic area or buttocks or with a human female's breast;
and
(9) "sexual excitement" means the condition of human male or female
genitals when in a state of sexual stimulation or arousal.

It's vague enough to allow prosecution for teaching human sexuality and responsible sex, anything involving homosexuality....

It's rather chilling since I hardly think actual porn is the norm for school students.
 
Let's make sure that the promotion of porn in schools is done the traditional way, from one teenage boy to another. The girls will look up naughty words in the dictionary and sneak mom's romance books to bed at night.

If the bill is too narrow (Catcher in the Rye for example), it will be stuck down by the courts.

I had a teacher come to me (I was school board president of an East Texas district), that a principal did not want him to use Huck Finn for racial reasons.

I had a talk with the Superintendent, who had a talk with the principal.

Now, teachers are legally bound to assign only approved books. They are free to recommend other books, but by law they are not supposed to assign books that are not on the approved curriculum reading list. And, yeah, if a teacher deliberately violates that law, uh-huh, they could end up in jail. It's very unlikely that a local prosecutor would try to get jail time for such a teacher, but if the law allowed for jail time for such violations, the prosecutor could seek jail time for the teacher.

Jail time for going off the approved curriculum? That's nuts. There is no pornography being given to students by teachers. The bill in question doesn't solve any problem. It creates problems. Because the 'not supposed to go off the approved curriculum reading list' narrative you just gave us, is exactly what this bill is for.

Its a bludgeon to threaten teachers to do as they are told. With jail time if they aren't obedient to a school board. School boards that are, unsurprisingly, trying to force teachers to teach creationism. .
How come you guys are all "obey the law" types when it comes to Christian vendors who simply don't want to be forced to attend a ceremony that they find morally offensive, but you're outraged over the idea of jail time for a teacher who knowingly violates the law on what books they can require students to read? What gives?

Several problems with your narrative. First, this isn't the law. Its a bill. An instant head shot to your manufactured 'but its the law' outrage.

Second, there is no actual problem that this proposed law solves. There is no pornography issue. So its a solution in search of a problem.

Third, the actual purpose was obvious even to you. Its a threat to teachers not to teach anything but the approved curriculum. Or else face JAIL time. The threat is repugnant thuggery. And tells us so much about the conservatives of Kansas.

Fourth, a Christian based sovereign citizen argument that your ilk are forwarding where Christians only have to follow laws they agree with is a non-starter. Its not our system of law nor ever has been. Christians are treated like everyone else. They don't get special treatment or special exemptions.
