Well, technically, there has been an entry of the judgment of conviction and of the sentence. Thus, until it gets ultimately reversed on appeal (unlikely at the shameless NY levels — but more than likely in a real court like SCOTUS), he is a convicted felon.

That said, since most of us grasp that the entire persecution was a political show, it is a pretty meaningless conviction.
