We weren't under a full scale invasion from another country. The war on terror took place in the mideast, not here. Our constitution also states we must have an election every 4 years. Considering we've never been under a full scale invasion since our inception, we don't know what we would do in Ukraine's place. Ukraine has laws that state under martial law no election can take place. It's that simple. Don't like it? Talk to the lawmakers of Ukraine. Zal didn't make that law, he's just following it.
