ICE is the "due process of law" and the 14th was written when use of jurisdiction applied to nation of one's origin. If not here with legal permission, an alien remains under the jurisdiction of the nation of origin. The term is separate from what nationality applies. Those Supreme court decisions are being challenged and could be revised.
