Judge Alvin Hellerstein found that Cohen was taken into custody July 9 and returned to prison in retaliation for balking at a condition that he not publish a book — about Trump or anyone else — while serving the remainder of his three-year criminal sentence on home confinement.

“I’ve never seen such a clause, in 21 years in being a judge and sentencing people,” Hellerstein said at a Manhattan federal court hearing held after Cohen sued this week to win his re-release from prison.


Biden would have been impeached for such an egregious abuse of power by the Repub controlled House.

Of course the court are not equiped to deal with multiple prosecutions of a former president and current front runner in an election less than a month away.

The founders never envisioned that such lawfare would be embarked upon by a political party, and certainly never envisioned politically charged federal agencies and courts aiding and abbetting such malfeasance.

Of course not. Our system of innocent until proven guilty, prohibition of ex post facto, confronting witnesses, unbiased judges, right to an attorney etc is not equipped to deal with rigged courts, corrupt judges, trials with foregone conclusions.

That is, a thorough examination of the facts by grand juries and trial juries after the defendant had every opportunity to defend himself resulted in the appropriate verdicts.

Upon proclamation by the President that there exists war or a threat of war, or a state of public peril or disaster or other national emergency, or in order to preserve the neutrality of the United States, the President, if he deems it necessary in the interest of national security or defense, may suspend or amend, for such time as he may see fit, the rules and regulations applicable to any or all stations or devices capable of emitting electromagnetic radiations within the jurisdiction of the United States.
Back in 2012 (before the age of Trump), I thought this grant of emergency authority was a wise decision, writing that “any President of either party should not be presumed to exercise powers granted in a dictatorial way.” And in the run-up to Trump’s election, I wondered if we could extend the same presumption to a putative President Trump.

Today, the answer to that question seems obvious. The fundamental norm to presume a lack of malevolent intent is now in doubt. And that, in turn, means that the entire postwar architecture of federal power—congressional legislation backed by executive discretion—is also in doubt.

The prosecutions are based on factual evidence considered by either a judge or a jury, following the recommendation of a grand jury, not politics.
