Indianapolis Cop Faces Felony Charges For Kicking Homeless Man - Is This Fair?

"An officer with the Indianapolis Metropolitan Police Department has been hit with a pair of felony charges after he was caught on bodycam footage kicking a handcuffed man in the head last month. Sgt. Eric Huxley was charged on Tuesday with official misconduct and battery with moderate bodily injury following an internal investigation lead by the Marion County District Attorney. He has also been suspended without pay and IMPD Chief Randal Taylor has recommended Huxley be terminated for his actions during the the arrest of Jeremiah Vaughn, which unfolded on Sept. 24 at the city’s Monument Circle."

Body camera video of the confrontation, played during a press conference on Tuesday, starts off with Vaughn, who is already in handcuffs, getting searched by police. He tells the arresting officer, who has not been named, that “nobody cares what you do anymore,” prompting a brief scuffle. aughn lands on the ground just a few moments later. Huxley then can be seen kicking the suspect in the head, telling him: “You’re done.”


If all that happened was that a homeless guy got kicked in the head one time, how is that a crime?? It's a fucking homeless guy, this isn't like this happened to a real person...The guy was in cuffs, yet he was still talking crap to the officers and not complying -- so in that case, I can see how a kick to the head would be appropriate....whoever the police chief is; he totally turned his back on his fellow officer....how are you going to recommend this guy be fired?? Doesn't seem fair at all.
 
Win. The riots and protests finally accomplished something. Just think, all it took was a willingness to hold the police to the same set of laws they hold others to.

That's nowhere to live, no nice warm bed to sleep in every night, no nicely-laundered sheets, no hot shower or bath to enjoy every day, no nice home-cooked meals 3 times a day.
No luxury clothing and luxury shoes to wear, no fluffy towels, no hope.
The man could have had a mental illness.

Depends. Was he black?
 
In my book, kicking any handcuffed individual at all (much less in the head) is ground for suspending the cop in question. Maybe he does deserve to be prosecuted too. We justifiably give police officers a lot of power and authority. We demand that they be properly trained too. Either he got trained poorly or he’s unfit to serve on the job, if the reports are true.

I have prosecuted alleged criminals. I have defended them too. One thing I don’t think our system can tolerate is a lawless cop. It undermines the entire concept of our system of “justice.”
