Some parts of the constitution specifically refer to US citizens for rights like voting, but other civil rights are applied to everyone whether they are a citizen or not. If a British tourist is charged with a crime in North Carolina they still get the same rights guaranteed Americans... warrant for search/seizure, probable cause for arrest, trial by peers, they can plead the 5th etc.

The illegal immigrant isn't even a criminal for being one, unlawful presence is a civil violation not a criminal one.
