It seems this law will differentiuate between "sexting" and real child porn. It could be a good thing ihopehefails.

Big government? no. I just think the states have the right to govern as they choose. Hence why i support the Constitution in limiting the powers of the Federal government and keeping a majority power with the States and the People.

If people of a certain State want to pass a law that some think is stupid, why shouldnt they? The whole point of the Republic is that a majority will rule.

I never understood the arbitrary outrage of 'it's not OK for the fed to ban an activity but it is OK for states to do the same thing'

Sexting does seem like child porn. You wouldn't let your 14 year post nude photos anywhere. So this law seems appropriate.

Why the hell should that be the standard? Lots of parents don't want kids to swear so should we make that a crime as well?

Its inviting the government into a 'private sphere' behavior that only society should handle on its own and turning it into the government's business.

Here is a hypothetical situation. A father gets a notice in the mail that his son is charged with a misdomeaner because he got hot sex texts from five hot girls. The father, who is kind of sexist, doesn't mind so much because he is realizing his son is a stud so normally he wouldn't care but the government comes along and does. You are kind of removing the personal choice from the parent to the state about how a child is to be raised.

Don't get me wrong, I think this behavior is really bad but should be handled by the community between the people.

let me give you a hypothetical. a 13 year old girl decides to send a 14 year old boy a nude pic of herself via text. the boy decides to send it to sall his friends because, well because he's a 14 year old boy. the boy's dad is a bit of a sexist so he thinks it's no big thing until the cops show up at the door and arrest his son for trafficking in child porn which is a felony. the boy is convicted and now the the 13 year old has to register as a level 3 sex offender for the rest of his life. seems to me this law is an attempt to make the punishment appropriate to the crime.

Hmmm. I'm trying to draw a parallel.......

Scenario 1:If a 14 year old girl comes onto my 15 year old son by opening her shirt in front of him in private should I be able to have her arrested?

Sounds like a "of course not".

Scenario 2:Unless we reverse the sexes then the female lack of equality issue comes up with a 15 year old boy who flashes his genitals to a 14 year old girl stands a higher chance of getting arrested.

Scenario 3: Change the discussion though to how sexting works. Lets say 15 year old Peyton and 14 year old Kati have been talking eachother up for an hour at a party. Should either be surprised or offended if the other makes an aggressive pass?

Now I might be a cool fella but in my life even bad girls just haven't randomly made passes at me to the extent of taking a chance of offending me.

nope. the girls in these cases are giving guys life sentences and/or a life of shame. its similar to people with aids sleeping around. they should be punished harshly.

No we don't and no we shouldn't pass such a stupid law for many reasons. It infringes of the free-will of individuals to choose their own course. Even if it is a bad course they still have the right to choose and some parents (who should be showcased on Jerry Springer) might not have a problem with that behavior so why should there rights be stopped?

Life, Liberty, and the Pursuit of Happiness and if your happiness involves having your daughter become a slut then so be it.

Now if there were pics between an adult and a teenager then other laws in existence, such as child pornagraphy laws, should kick in but how can anyone call this child pornagraphy when it is between two children? The laws against child pornagraphy themselves state that the sex act has to be between an adult of certain age and a minor below a certain age so how can child porn laws apply when it is between two minors below a certain age?

This is why being a republican is so damn hard sometimes.

No it doesn't seem right to me. I'd go so far as to say adult men get a pass on any girl who manages to sneak into an 18 and over establishment. Seems reasonable to me to expect anyone I meet in a bar is 18 (probably 21!) or older. Of course if they're wearing a High School Jacket with "12" on the shoulder you should know better lol.

As a side note I know a most likely gay man who is a small time photographer. He ended up with his small town sheriff questioning him about some pictures he took of underage girls. Fella would be in jail if he hadn't scanned copies of their fake ID's as a matter of precaution.
