Felony - any crime where the maximum incarceration is a year or more in prison
Misdemeanor - any crime where the maximum incarceration is less than a year
Violation - any crime punishable only by a fine. No incarceration
So as you can see, it takes very little to qualify as a felony. Pete Rose and Martha Stewart are felons! Thousands of other felons in america committed a crime so minor they got straight probation with no prison time. This liberal idea of denying constitutional rights to felons needs to be re-examined.
That's not true. At least not in Pennsylvania. You can be incarcerated for a Misdemeanor of the 1st degree for a maximum 5 years, a M2 for 2 years, and a M3 for 1 year.
Felonies of the 3rd start with a maximum of 7 years, F2 a maximum of 10, and F1 10+
It's the legislator that determines what charge is what grading.
To pretend as if it's the same throughout the nation isn't correct.
So we know of at least one rightwingnut who doesn't know the difference, either.
