IMO, if you get shot, and killed, playing a prank with one, you deserve it.

IMO, if you get shot, and killed, playing a prank with one, you deserve it.

In Texas, pointing a fake gun at someone, where the fake gun looks real to any reasonable person, is assault.

BUT, it could get bumped up to Aggravated Assault = 2nd Degree Felony if one uses a BB gun or airsoft gun, because both are capable of causing serious bodily injury.

Either way, if an idiot pulls out a fake gun and it looks even halfway real, it's a defense to prosecution for anyone who shoots said idiot.
