A man’s gun charges have been tossed after a judge found guards at a Toronto jail co-ordinated a “shocking and disturbing” coverup of their colleague’s excessive use of force — despite video evidence showing his account was “obviously untrue.”

In a ruling released this week, Ontario Superior Court Justice Jennifer Penman found that the unwarranted use of pepper spray on the inmate, the 15 days’ solitary confinement he was subjected to following the incident, and the guards’ collective "cover up" efforts to falsify reports and mislead the court culminated in a serious violation of Charter rights.
