Supreme Court Justice Neil Gorsuch delivered a sharp rebuke to Justice Ketanji Brown Jackson on Tuesday, accusing her of “fundamentally misconceiv[ing]” Supreme Court precedent in a major ruling that struck down Colorado’s ban on conversion therapy for minors as applied to talk therapy.

Colorado’s law at the center of the Chiles v. Salazar Supreme Court case bars licensed counselors from engaging in “conversion therapy” with minors, broadly defined to include any talk therapy that seeks to change a person’s sexual orientation or gender identity, while expressly allowing counseling that affirms identity exploration or gender transition. In a major First Amendment ruling, the Supreme Court said that distinction amounts to unconstitutional viewpoint discrimination when applied to speech‑only therapy, holding that states may not dictate which perspectives counselors can express to willing clients—even in the name of regulating professional conduct—without meeting the Constitution’s most demanding free‑speech standards.

The Supreme Court issued a near-unanimous ruling striking down the law on Wednesday, with Jackson being the lone dissenter.

Ketanji Brown Jackson Is Not the Idiot You Think She Is

Jackson's dissent was a wonder to behold, not least because it contradicted her dissent from last year on a case having to do with transgender surgery for minors. In that case, she claimed the state had no business interfering with medical judgment; in this case, she asserts that the state has an absolute right to interfere with medical and counseling judgment.

Critical Legal Theory is essentially the toolkit used by Marxists to shape the law to say whatever they want. You and I keep looking for words and references to say something about what is real, but reality is what critical theorists say it is, and they say it is whatever they need it to say.

We are looking for "epistemic adequacy," or correlation with reality. Or in her case, correlation with the Constitution and established law. She sees that as an oppressive assertion of power by the dominant hierarchy to impose injustice. So she simply defines those away.

It's a travesty a state passed this law, and even more of a travesty that one of our SC Justices thought it was fine and dandy.

This is the DEFINITION of a violation of free speech obviously: when the govt tells citizens "you can't say that".....

I am OK with them banning things like Conversion camps and any physical methods.

As usual though, the left goes too far, and makes laws that go overboard, as this law did.
 
Gorsuch is a hack and plays judicial calvinball.

Of course they were going to decide for conservative therapy.

But they’d also ignore their belief in the first amendment when they decide that a law that forces doctors to say specific things to women seeking abortion, even if they’re not scientifically valid, is perfectly okay.

Because the first amendment applies only when it’s convenient for them.
