Kagan is right, I think, and Roberts wrong. When handling bankruptcy cases, the judge has the power to make decision beyond the immediate fiduciary context. In other words, if you go bankrupt, do not try to hide assets.

if you HAVE any assets worth hiding, you shouldn't be allowed to take a (personal) bankruptcy in the first place.
