The Talmud suggests that the Torah statement "eye for an eye" was not to be taken in the literal sense. This is one reason why Jews are strongly against capital punishment. They aren't alone. In the case of egregious abuses against others, there must be reciprocity or there will be little deterrent. The local stick up kid is a poor thug, often from a broken home, they have nothing to lose so capital punishment wont deter them. Abuses of power by those in prestigious positions however, DO have much to lose, so they will be more cautious.
