Dershowitz is simply wrong. Regardless of the reasons it was put into the Constitution, it is in fact, still in the Constitution and will apply to anyone who commits insurrection or rebellion OR gives aid and comfort to those who do.

Trump’s distinct legal woes will congeal in voters’ minds into one undifferentiated procedural drama, and Americans love a good procedural drama. They and the press will follow every minute of it to the exclusion of the issues on which Americans might otherwise vote in 2024.
