Federal judge stalls Obama's executive action on immigration

The next appeal would be to the Circuit Court. Then the SC.

Obama will appeal the injunction. Then, assuming the actual judicial decision doesn't go his way, he will go up the chain again.

I believe that since Obama is not the entity of a state, he would have to appeal to the U.S. Court of Appeals rather than one of the 12 circuit courts. I still question if the court would find that Obama has standing for such an appeal?

The US Court of Appeals is divided by circuits. The appeal will go to the circuit where Texas is located. Since the Executive Branch was sued, they certainly have standing to appeal.

There are 12 Circuit Courts, and one U.S. Court.

{ In addition, the Court of Appeals for the Federal Circuit has nationwide jurisdiction to hear appeals in specialized cases, such as those involving patent laws and cases decided by the Court of International Trade and the Court of Federal Claims.}

Federal Courts Structure

Obama might fall into the circuit court, but he might also be in the U.S. court as he is not part of the state in which the action took place.

The appeal is in the Circuit where the lawsuit was filed. He can't shop courts.

Any shut down would clearly be the fault of Obama and the Democrats. Everybody knows that.

Yeah! Everybody knows that!
Yep

No.

Because guess what? Obama doesn't have to sign the bill. He can veto it, and Congress can try to override his veto. Obama isn't powerless here. Republicans need to learn the word "compromise" and maybe their defeat in 2016 won't be so bad.

Oh and 1 more thing. It's a Republican judge. Why is the right all of a sudden for judicial activism?

Hanen, who's been on the federal court since 2002 after being nominated by President George W. Bush, regularly handles border cases but wasn't known for being outspoken on immigration until a 2013 case.

The judge made the right choice. We do not REWARD criminal behavior period. Round them all up, mom, pop, the kids, and the old drunk uncle except at mass on Sunday, and send them direct to Point of debarkation

Yeah, that horrible criminal that was 5 when they came over. Went through the K-12 system and got an education and has loved this country. EVIL CRIMINAL!!!!

There is no defensible reason illegal aliens should be allowed to stay in the USA. Not one.

We can sit the criminals down all day long and hear a host of flawed logic retorts as to why they should stay, yet no excuse for why they violated the law.

Actually, it's kind of a stupid ruling? How is the judge going to make the INS go after these individuals specifically?

Here's the problem you guys don't get. We have anywhere from 11-20 undocumented people here. Yes, let's call them illegals to make you happy, but the vast majority of them are obeying the law and being productive.

We only have enough resources allocated to deport about 400,000 a year. That's the time to identify them, detain them, give them hearings and get their home countries to take them back.

So which 400,000 do you send back? The ones who are actually committing crimes or being bad actors, or the ones who came here as children, speak english, hold down jobs and go to school?
1. Do the "good ones" pay taxes while working, speaking english, going to school?
2. Do the "bad ones" pay taxes while robbing, murdering, trafficking drugs, sucking off welfare while doing nothing but collecting whatever they can get?

Deport the baddies. Keep the goodies but make them pay taxes and back taxes since they first arrived ILLEGALLY.

Did the good ones or the bad ones..doesn't matter which...BOTHER to go thru the legal procedures to BECOME CITIZENS? Nope. If they did..they would have to pay taxes. Paying taxes means no money to send back to mexico to families they was planning to sneak over here to join them.

If they are not documented. HEAVE THEIR ASSES TO THE BORDER. Period.

Send 'em all back and let Allah sort 'em out?

Obama is pushing a phony issue here, all illegals have to do is immigrate legally. Is that asking too much? Follow the laws and such? Is it too much to ask rapists not rape, drunk drivers not drive, Jaywalkers....Please.

No.

Yeah because Freedom of Religion is not a thing.

You don't understand. Obama doesn't want intelligent hard working illegals coming here. He wants latin america to dump their criminals and welfare bums on us.. Those are the people that will go on welfare and vote for the welfare party.

Satan worshipers should let satan sort them out.

Yep, the dems know they're toast on this issue, that's why they are slow walking the appeal, they could have asked for an expedited appeal and didn't. The judge may have also provided a way to stop the FCC and their internet taxes, they failed to follow the Government Procedures Act by not giving advanced notice and allowing public input.
