More judges taking bribes from mexico but it won't matter. The SC will say the 14A actually BANS straight birthright citizenship. The pertinent clause is "subject to the jurisdiction thereof."​

oct 3 2025 BOSTON (AP) — A federal appeals court in Boston ruled on Friday that the Trump administration cannot withhold citizenship from children born to people in the country illegally or temporarily, adding to the mounting legal setbacks for the president’s birthright order.

A three-judge panel of the 1st U.S. Circuit Court of Appeals became the fifth federal court since June to either issue or uphold orders blocking the president’s birthright order. The court concluded that the plaintiffs are likely to succeed on their claims that the children described in the order are entitled to birthright citizenship under the Citizenship Clause of the 14th Amendment.

If they're not subject to our jurisdiction, then our government judicial system has no standing to do anything about them.

HAHAHAHA. Hey einstein. By "jurisdiction" the 14A means political jurisdiction not legal jurisdiction. Everybody in america is subject to our legal jurisdiction obviously. Foreigners can't invade america and rob banks and say "Your laws don't apply to me." THINK

Political jurisdiction grants authority of a government to apply its laws within its territory. Think of how diplomatic immunity works and how their children are exception to birthright citizenship.

Diplomatic immunity aside, for sure our laws apply to foreigners. I never implied they didn't. According to your interpretation, these children born here of illegal foreigners should be granted a lifetime get out of jail free card since they're not under our jurisdiction.

all foreigners still have the protection of their home countries,, so none of them are subject to our jurisdiction,,

If they commit a crime in this country, then yes, we have jurisdiction over them.

And lo and behold, they broke a law coming here ILLEGALLY.

Jus soli (by land) is an archaic interpretation of our citizenship laws. Jus sanguinis (by blood) would make more sense. It would immediately tighten our nationalization rules to prevent abuse of our immigration laws.

What we are really arguing over is giving taxpayer benefits, checks, education, etc. to those involved. This is a major issue. And it costs more and more money.

if they meant under our laws they would have said that,, two different words with two different meanings,,

This means the entity is bound by the laws of that jurisdiction and can be legally compelled to appear in court, obey decisions, or face sanctions for violating those laws.

But as the Supreme Court ruled in United States v. Kim Ark decided, children born here are citizens not foreigners.

their parents are foreigners so their children are also foreigners and both are under the protection/jurisdiction of their home country just like if an american was in a foreign country,,,,,,
