A defendant in the Michigan Gov. Gretchen Whitmer kidnapping case has moved to introduce evidence related to the use of federal informants in the Jan. 6, 2021, Capitol Hill breach, arguing that the FBI’s refusal to answer basic questions about such activities demonstrates a “Consciousness of Guilt” by the government.

The Jan. 6, 2021-related evidence that attorney Scott Graham seeks to admit is the refusal by top Department of Justice (DOJ) and FBI officials to discuss the use of informants in the U.S. Capitol breach. According to Graham, the FBI’s lack of transparency demonstrates its “Consciousness of Guilt”—a term, typically reserved for defendants, to describe when someone conceals evidence, intimidates witnesses, or does something else that makes him or her look guilty.

“The testimony of the people in both groups is crucial to the presentation of a defense in this case. Mr. Franks therefore asks for an order compelling the government to obtain orders for use immunity for its agents and sources.”
A motion hearing is scheduled for Jan. 18, followed by a final pretrial conference on Feb. 18 before the March 8 trial.


Commentary:
The sad part is that Judge have the Absolute Authority and uphold the standards of law, doing the right thing and stop this crap, by Dismissing with Prejudice holding the FBI and the US Attorney personally in Contempt imposing the Maximum Allowed Sanction including JAIL and Fines in the $10,000 Plus range, then of course referring the case to the DOJ for Criminal Charges recommending to the ABA the Lawyer be DISBARRED.
The directors and SAC's of the FBI and DOJ are in effect pleading the 5th to prevent self-incrimination and complicity in the Whitmer kidnapping attempt.?
Like The Gestapo, The KGB, STASI, Cheka, FSP, CSP, and all corrupt agencies of Marxist Socialist nations of the past and present, The FBI has emerged as America's nefarious secret police for a Totalitarian government. So, what would their unvarnished testimony and captured communications likely reveal? That without the elaborate involvement of the FBI, which compensated the lead informant at least $50,000 for six months’ work and funded every outing to produce photographic evidence of the defendants’ participation in weapons training camps and reconnaissance missions, the plot never would have made it past idle chatter.

The jury also would hear how Stephen D’Antuono, the director of the FBI’s Detroit field office, handled his agents executing the caper and how he was swiftly rewarded for his work. After his office successfully produced damaging headlines for Donald Trump right before the election, D’Antuono was promoted to head of the FBI’s D.C. office just three months before the Capitol protest.

Unsurprisingly, prosecutors have already told the defense that they have no intention of offering immunity to their now-tarnished star government witnesses. It’s unlikely a judge will avoid interfering in what is the sole purview of the Justice Department to offer immunity deals.
But watching these FBI agents and informants repeatedly plead the Fifth on the stand may be as revealing as any protected testimony.
