with all due respect, watch it again. Start at time mark 1:20. Repeat it until yiu see what is being yelled and hear all gunfire (it is clear that there are at least two different calibers being fired. Kyle's .223 is unmistakably much louder and more powerful).

If you're still not convinced someone OTHER than Kyle fired the first shot, assume he shot first and watch it again.

Anyway you slice it, Kyle was not the aggressor, and before shot were fired, was clearly being chased across the parking lot by a guy or several who had been yelling and threatening violence.
