Well that is an asinine assertion. It certainly does not indicate that. This is particularly true when they keep getting caught lying.


There seems to be almost no coverage of the deal though. Color me shocked there as well. The FBI is losing all of its credibility.

If the FBI had arrested your stupid ass and the DOJ had prosecuted you for a crime and the court had ordered an agent’s computer to be forensically searched BUT the agent instead illegally wiped the hard drive to prevent the search (which would have yielded evidence of your innocence), would you be babbling some smack about Trump fascists?

The answer is: of course not. What you’d be crying about (validly so) is the denial of justice to you.

AFAIK, it does.

But I am not a judge so I do not have a position of authority on the matter. However, you CANNOT have a fair trial if the prosecution destroys evidence. It is flatly impossible. With that in mind, the ONLY right thing to do here is exonerate the individual in question. This is why tampering with evidence is such a massive deal. The government can prove anyone is guilty if they are able to tamper with evidence and/or destroy exculpatory records.

All I could find is prosecutorial misconduct which can include a tampering with evidence but not anything covering specifically finding police destroying evidence after a conviction and yes, there they can outright exonerate or demand a new trial. How do you demand a new trial though when the exculpatory evidence is DESTROYED? What possible rout does the accused have of obtaining justice?
