The debate over whether poor old Swallowall did the deeds attributed to him does turn on evidence. While it is true that an alleged victim’s in-court sworn testimony (and possibly being subject to cross examination) would constitute “evidence,” it is ALSO true that it might not be seen as rising to the level of proof beyond a reasonable doubt.

Not that very long ago, the left was adamantly demanding that we must believe all “women.” It was sometimes cast as “believe all victims.” Regardless of how it was phrased, such a demand, back then, was flatly ridiculous. It still is.

If you are a juror and accept that nonsense as being required, then you must prejudge the verdict. Her merely making a claim would override the presumption of innocence and the right to a fair trial.

As a non-juror, I am inclined to believe the accusations against Swallowall. But, still, like anyone accused of a crime, he is entitled to a fair trial. Prejudging him is not fair.
