Wow, the Constitution on your planet is SO different from the one we use on Earth!
Actually, Whitaker's appointment is legal, and the exact Law making it legal has been cited.according to the Appointments Clause - Wikipedia
28 U.S. Code § 503 - Attorney General
The President shall appoint, by and with the advice and consent of the Senate, an Attorney General of the United States. The Attorney General is the head of the Department of Justice.
oops; that NEVER happened
America, you have yourself a good little Hitler hapnen
'Unlawful': Napolitano Agrees With Legal Challenge to Whitaker Appointment
What is NOT LEGAL is a criminal Assistant US AG already guilty of Obstruction of Justice, already cited as having a part in deceiving FISA Court Judges in order to illegally obtain illegal warrants, who continues to ignore the US IG's recommendation to indict the former Deputy Director of the FBI, and who is a witness in the case he is currently in charge of overseeing remaining in charge of the proven on-going Witch Hunt.
And Trump can promptly fire him.Rosenstein would be 'next up' for AG; that whole line of succession crap & all.
.
Then it would go to the next in line.
But he CAN'T simply put in whatever croney he feels like putting in without congressional confirmation process.
And politically he can't fire Rosenstein - even some on the right will not go along with that (see Ben Shapiro for example who explicitly drew that red line)

The biggest problem with this argument is that Rod Rosenstein has the same problem as Whitaker.
He was not vetted and appointed under the advice and consent of the Senate.
Because it is an interim position, and because Trump has the authority to make unilateral lower-level employment decisions in the DOJ, Trump can fire every motherfucker that stands before Whitaker.
This is shaping up to be an interesting court battle, that the SCOTUS will likely hear and could end up shoot down the law as unconstitutional. It seems to me that the intent of the successor statute is for "Designated Survivor" scenarios, but I expect the SCOTUS or any lower court to look at the language of the statue and give it the proper meaning as written before moving to constitutionality grounds. The biggest problem with this argument is that Rod Rosenstein has the same problem as Whitaker.
Your biggest problem is that you're a complete dope.
Rod Rosenstein confirmed as deputy attorney general
Longknife, why are these people so damn dumb?!?!?!?!?!
They keep purposely arguing apples to oranges, lol. A President can appoint ANYONE temporarily to ANY position for the length not to exceed 210 days as long as------->he/she was in the administration for at least 90 days, and was at the minimum of level 15.
Dumb?
It was your dopey brother who claimed Rosenstein wasn't confirmed.
Dopey brother? IRRELEVANT-------->this thread is about UNCONSTITUTIONAL appointment, which it is not! He can not serve more than 210 days, that is the law. It is up to the President to decide who he wants TEMPORARILY in that position, while he chooses another candidate for confirmation. NO WHERE in the constitution, does it say the President MUST pick the deputy AG as the replacement.
If it does, show us where it is!

Moron, the Vacancies Act allowed it...you moron.
Federal Vacancies Reform Act of 1998 - Wikipedia
The law designates three classes of people who may serve as acting officials:
- By default, "the first assistant to the office" becomes the acting officer.
- The President may direct a person currently serving in a different Senate-confirmed position to serve as acting officer.
- The President can select a senior "officer or employee" of the same executive agency who is equivalent to a GS-15 or above on the federal pay scale, if that employee served in that agency for at least 90 days during the year preceding the vacancy.[2]

Yeah....Cheeto's army of lawyers didn't consider all these angles, only to have some anonymous lolberal whackaloon on an obscure message forum see through it all, with this staggeringly air tight constitutional argument!Oh good ...about the tenth thread one this garbage.....ZZZZZZZZZZZZZZZzz
and did anyone within any of the 'claimed' threads demonstrate the Appointments Clause from The US Constitution, or 28 US Code 503?
OK; I didn't think so.
So, you like it when POTUS shits all over The US Constitution?
