No, it isn't.... You have to be charged with a crime and found guilty for you to be a criminal. That's just plain fact under the justice system we are governed by. We are all innocent, until proven guilty in a court of law...

And if our govt chose not to prosecute and just fine them under a civil offence and not the criminal misdemeanor offense also, then they are not criminals....they are simply illegal entrants. This has happened a lot.

It's a civil offense not criminal, the first time crossing unless the govt takes them to court and charges them with a misdemeanor and wins. Asylum seekers meeting preliminary criteria are not criminals, until they've been denied asylum in a court hearing, and refused to leave. And they are not criminals if they applied through the parole program.....unless they break the parole agreement rules.

So yeah, it isn't one simple yes or no answer.
It's a MISDEMEANOR, the first time, and a FELONY the 2nd time. That's CRIMINAL, not civil.

A fiery exchange took place at the Senate Budget Committee hearing on Tuesday when Sen. Bernie Moreno asked a former Biden adviser whether illegal immigration into the United States is a crime.

Moreno posed the question to Democrat hearing witness Brendan Duke, a former senior policy adviser in the Biden White House who is now senior director for federal budget policy at the Center for American Progress.

“I don’t know anything about this law,” Duke replied when Moreno asked if the 1952 Immigration and Naturalization Act “made a mistake” barring people from entering the United States illegally, Fox News reported.
