Actually it could fall under that umbrella. But it is up to Congress, not the courts, to take him to task for that. If sufficiently serious to justify impeachment and removal from office, THEN he could be prosecuted for that. Since that is unlikely to happen all we can do is vote the Marxist totalitarians out of office and put a constitutional government back in power. We'll just have to hang on until then.
