This is clearly the fault of the helicopter pilot. It violated the 200’ altitude restriction. And it doesn’t take long for a chopper to ascend an excessive 200’ before ample warning can be issued. It only needed those 200 extra feet to line up with the jet’s altitude.

The pilot and whoever in the tower was supposed to be monitoring them.

In each case Germany and United States there are additional idiosyncratic rules imposed so that factors other than the popular vote count, are used to determine the winner.
