A parting gift from the office of Johnny Sutton, he snagged one last Border Patrol Agent to throw on the fire for Mexico before leaving office. Sutton’s cases were “flimsy”. He destroyed the lives of about a dozen Border Patrol agents and Law Enforcement officers. Remember Compean & Ramos trying to stop a drug smuggler with 800 lbs. of pot and end up behind bars themselves for 10 & 11 years.
The Parting Gift of Johnny Sutton:
Customs and Border Patrol Agent Jesus Enrique Diaz, Jr., 31, father of 6 and an eight year veteran receive a 2 year prison sentence this week. He was charged with depriving a 15 year old drug smuggler his constitutional right to be free from the use of unreasonable force by one acting under the code of law.
Incident:
On October 16, 2008 BP Agent Jesus Diaz was with a group of other agents when they captured a group of illegal alien drug smugglers after crossing the Rio Grande River near Eagle Pass, Texas. The smugglers had just crossed the river and were carrying bundles of marijuana in backpacks.
At 2 a.m. the agents had apprehended the drug smugglers and put them in handcuffs. Agent Jesus Diaz and Agent Marco Ramos stayed behind to guard and question the smugglers while the rest of the agents went to look for hidden bundles of marijuana in the bush.
One of the drug smugglers was a 15-year old boy who was 'uncooperative and resisted arrest.' Agent Jesus E. Diaz had the boy in handcuffs and was struggling with him. Then he lifted up the boys arms to force him to the ground and then put his foot on the boys back to force him on the ground, “a near-universal police technique.” Here’s where the problem begins.
“The Mexican consulate in Eagle Pass had filed a formal written complaint just hours after the arrest, alleging that the teenager had been beaten.”
Homeland Security’s Inspector General and the Immigration, Customs & Enforcement (ICE) investigated the incident and found Agent Jesus Enrique Diaz of no wrongdoing.
A year later the U.S. Attorney’s Office for the Western District of Texas brought charges against Diaz.
The Mexican government aggressively sought prosecution of B.P. Agent Diaz. The 15 year old drug smuggler was given immunity to testify as a government witness against the Border Patrol Agent.
The teen’s defense did everything but play a violin in court by selling the kids as waif and just a poor immigrant selling dope to feed his poor family and portraying him as the victim.
In court the boy said he had no injuries other than sore shoulders. The Defense said there were no bruises of any kind on the boy. Photographs showed that the only marks on the lad came from the straps of the back pack that he was carrying which was loaded with 75 pounds of drugs. There was no bruising on his back or wrists.
Many law enforcement agents and supporters believe that the charges were politically motivated. “It was solely motivated by politics and is yet another example of prosecutorial abuse and misconduct while protecting Mexico's narco-terror influences.
The Law Enforcement Officers Advocates Council (LEOAC) said the government’s case was “based on false testimony that is contradicted by the facts.” They went on to say that the "witnesses lied to the courts and later admitted to having perjured themselves. This was ignored by the court and the government.”
The arrest took place at 2 a.m. and it was so dark no one would have been able to see what took place. Border Patrol Agent Marcos Ramos who was with Agent Diaz testified that he saw no mistreatment.
Customs and Border Patrol Agent Jesus Enrique Diaz, Jr., is married to Diane who is also a BP agent of 15 years. He has 6 children the youngest was born in the spring of 2011. Agent Diaz comes from a long line of law enforcement officers in the Southwest.
Many supporters and advocates say this is far from being over so, we’ll have to hope that we can free Agent Diaz from injustice very soon.
