What is the proper context for the property rights of private corporations?
It's the same as any other persons property rights. Maybe you're not getting what I'm saying.
The 5th Amendment. Read it carefully. It's specifically FOR the governments authority over a suspected criminal.
"No person shall be held to answer for a capital, or otherwise infamous crime, unless on a presentment or indictment of a Grand Jury, except in cases arising in the land or naval forces, or in the Militia, when in actual service in time of War or public danger; nor shall any person be subject for the same offence to be twice put in jeopardy of life or limb; nor shall be compelled in any criminal case to be a witness against himself, nor be deprived of life, liberty, or property, without due process of law; nor shall private property be taken for public use, without just compensation."
The last line is also about the governments authority over suspected criminals. And does not actually grant corporations or even other private citizens rights to the actual property owners land. But because it's been "bought and paid for" by corporations, they're using the government (courts) to take away the property rights of the land owner.
Id say it's meant to keep the government from things like civil forfeiture or in stances like when a druggy gets caught with say 50lbs of pot in his vehicle. The 5th is what's supposed to keep the government (even local law enforcement) from confiscating the vehicle.
