Judge Louis Guirola Jr. ruled that “sex” in the 1972 statute refers to biological distinctions, blocking HHS from expanding the definition. The nationwide ruling halts enforcement of the rule.

Guirola said, “The Department of Health and Human Services exceeded its authority by implementing regulations redefining sex discrimination and prohibiting gender identity discrimination.”

Guirola added, “A statute cannot be divorced from the circumstances existing at the time it was passed.”
