Executive Orders are short cut executive directives, actual to the people operating under the executive branch, (which isn't everybody, by the way), and are shotcut around the laws that either they did not have the time to wait to be passed, or they knew would never be passed. Sometimes, they are challenged in court, sometimes ruling them illegal on constitutional or legal grounds under our laws and constitution. But, no. They are not based on laws. If there were a law for something to be done, there would be no need for an Executive Order, other than a photo op.

Mostly Trump just overruled or changed laws on the books, by executive action only, (nothing lasting), as he could not pass what he wanted, even with control of the House, the Senate and his appointments to the Supreme Court. Which is why many have been challenged and overturned.

A department established by Congress as the Department of Defense, by the National Security Act of 1947, a law passed by both houses of congress and signed into law by President Harry S. Truman, is up to Trump to rename by personal whim, over the actual law, passed and signed into law, not by Executive action, but actual law?
