In terms of the attributes of statehood, the main criteria examined in the submissions are
those set out in article 1 of the Montevideo Convention, namely: (a) permanent population;
(b) defined territory; (c) government; and (d) capacity to enter into relations with the other
states.
(a)
Palestine has a core population that goes back hundreds even thousands of years.
Israel's core population is recent immigrants.
(b)
Palestine has defined and recognized borders.
Israel has no borders.
(c)
Both have governments.
(d)
Both have relationships with other states.
Note:
A number of submissions assert that the territorial integrity of Palestine has been recognized and reaffirmed in resolutions of the UN Security Council and General Assembly and by the International Court of Justice. Palestines limited control of the full extent of its territory does not affect such integrity, since it results from a state of belligerent occupation.
