An EMT is not qualified to diagnose an illness.

An emt can determine the temperature of the patient. They are there for emergencies and that was one. I don't know for sure if an EMT was there, it doesn't say in the story.

An EMT can determine a patient's temperature, but is not legally qualified to diagnose why the patient has a temperature. That is why a judge, and cops must have an opinion by an MD or DO if they force entry, if they want it to stand up in court. A patient with a temperature of 102, for example, is no big deal, unless an MD determines that the child has double pneumonia, for example.

When I was a kid, you could call a doctor, get him out of bed and come to your house in the middle of the night. Its no different than any other child neglect case. This instance had a doctor actually see the patient and would be able to testify that they needed to get to an ER.
