You would think after the debacle engineered by Trump's former lawyer Lindsay Halligan, that he would be careful and fully vet any other appointments. But no, he just reaches into his bag and pulls out another one doomed for failure, this time his former lawyer Alina Habba. Of course, we all know that Trump's only criteria for appointment is "does the person like me? If so, it's a full go.

The incompetence of this president is epic and mind shaking. He has done the impossible, making Richard Nixon look like an angel and making Dubya look like a genius.

It is apparent that the current administration has been frustrated by some of the legal and political barriers to getting its appointees in place,” Judge D. Michael Fisher, an appointee of President George W. Bush, wrote in the 32-page opinion. “Its efforts to elevate its preferred candidate for U.S. Attorney for the District of New Jersey, Alina Habba, to the role of Acting U.S. Attorney demonstrate the difficulties it has faced — yet the citizens of New Jersey and the loyal employees in the U.S. Attorney’s Office deserve some clarity and stability.”

The ruling further stymies the Trump administration’s use of unusual tactics meant to quickly put or keep largely unqualified U.S. attorneys in place without Senate confirmation. Defendants are also challenging the authority of U.S. attorneys in California and Nevada, where judges have determined the Trump-picked prosecutors are serving unlawfully, and in upstate New York.

In a loss for the Trump administration, an appeals court on Monday upheld a lower court ruling disqualifying Alina Habba from her position as acting U.S. attorney for the District of New Jersey.

In a 32-page ruling, the 3rd Circuit Court of Appeals found that Habba's appointment violates the Federal Vacancies Reform Act.

"It is apparent that the current administration has been frustrated by some of the legal and political barriers to getting its appointees in place," wrote Judge Michael Fisher.

The decision stems from a motion from Julien Giraud Jr., a New Jersey man who faced drug trafficking and firearm charges that predated Habba's appointment. Giraud moved to dismiss his indictment on July 27, arguing that President Donald Trump's appointment of Habba, who had been overseeing the case, was unlawful.


Alina meets a fate similar to Lindsey's? Another illegal act by a lawless regime?

If the regime had a suggestion box I would put a note inside suggesting they find qualified candidates for US Attorney rather than loyalists not likely to receive Senate confirmation.

The Constitution (Article II, Section 2) requires Senate advise and consent on filling vacancies for "Ambassadors, other public Ministers and Consuls, Judges of the supreme Court, and all other Officers of the United States whose Appointments are not herein otherwise provided for, and which shall be established by Law: "

It's the "which shall be established by law" the power of Congress to define which positions require Senate confirmation as "other officers" and the procedures therefore used.
