American Samoa residents are suing to earn citizenship at birth, The Associated Press reported Tuesday.

Residents of the U.S. territory aren't considered citizens, but are recognized as U.S. nationals.

This means the residents are not permitted to vote, sponsor relatives immigrating to the U.S. or run for office. However, they do pay taxes to U.S. officials.

The lawsuit was filed by American Samoa residents living in Utah. They are suing for the right to citizenship under the 14th Amendment, which grants American citizenship at birth to anyone born in the country, the AP reported.

They already failed once, even the government in Samoa doesn't want it.

They should just put it to a vote as to whether they wish to become our 51st state. If it fails, well, they tried, again.

“However, they do pay taxes to U.S. officials.”

Taxation without representation – where have we heard that before….

Fortunately, our Constitutional Republic affords them a non-violent means to petition the government for a redress of grievances.

They have a compelling case, we all should hope they’re successful.

As long as the voting majority keeps voting against becoming a state, they have no stand on the issue. Puerto Rico also keeps voting against statehood and as long as you're not a state, the situation doesn't change.

Taxation without representation. That was a HUGE part of why the America declared its independence from England! This is ridiculous. Either let them become a free nation of their own or make them US citizens etc. I don't see this as a republican or democrat issue I see it as an American issue.

Puerto Ricans are natural born citizens.

PR voted for it last time

Guamanians are citizens, too.

As are Puerto Ricans. Including my father in law. I don't believe they should have been granted citizenship without being forced to become a State.

And should the same be the case for the District of Columbia? The United States has a long history of non-state territories whose inhabitants always enjoyed citizenship no different than those of the states. The framers envisioned such territories, possibly become states some day, possibly not, but never envisioned those people being excluded from citizenship.

renounce Samoa now--we don't have the time or $$$$ for this stupid shit

That's the rub here. The territory does not want to give up the benefits of not really being a part of the US (such as tax and local government) but then when some decide to move to the mainland suddenly the advantages become obvious.

What is interesting to me is that there really is a decent argument to be made here - if we are considering that anyone born under the jurisdiction of the US as a natural citizen as the text of the constitution states then it stands to reason that territories would count as they are "under the jurisdiction" of the USA.

You might want to read the 14th Section one again. They aren't born in the Unites States, PR and US Virgin Islands are citizens by statute, not because the 14th made them citizens.

Of course they don't. The same can be said of all US territories. They can all vote to become a State but never do. If they become a State then they have to do as the rest of the country does. Why buy the cow when you get the milk for free??

Irrelevant. The 14th says nothing at all about states. It mentions 'jurisdiction' and it is a tough argument to behold to try and state that those territories lie outside US jurisdiction.

I never understood why we allow this half status tbh. Either join the US or stay sovereign. I see no real reason to have territories that are not full states.
